Trademarks not owned by Kayakalpsh and referenced on this website are the property of their respective owners.

PRIVACY NOTICE

The matter of safeguarding your privacy is taken seriously at Kayakalpsh. The information we collect from our guests and website visitors is used by Kayakalpsh to understand and serve their needs.

The information that can be used to identify you as an individual is referred to here as ‘Personal Information’. It can include, but is not limited to, your name, address, age, gender, personal financial information, personal lifestyle history and personal medical history.

The Personal Information that we collect is used to assist us in making your reservation, providing you with the services you request for, meeting your retreat objectives and other needs while you are staying with us, and/or to allow us to contact you for matters that arise from your stay with us.

Guests are required to sign a disclaimer after their wellness consults and before starting their wellness program. Guest information is shared within the Kayakalpsh team to craft the best program for each guest, to address your needs and preferences, and for our internal learning. This includes health or medical information where relevant. Sensitive medical or personal information is only shared when necessary and usually only within the wellness team. Please let your consultant or specialist know if there is anything you wish them to keep confidential; however, this might affect their ability to provide certain treatments or services.

In order to provide certain additional services related to your stay, information may be shared with select third party vendors. Kayakalpsh will be in contract with these companies and will contractually require them to protect all guest information that they have access to. Certain stay related Personal Information is kept on file and such information regarding guest history and billing details allow our guests at Kayakalpsh the ability to check, re-confirm transactions with us and reconcile statements or invoices.

We may use the Personal Information you provide to stay connected with you post your stay at Kayakalpsh, we may send you information, assist with your wellness goals or send other information that may be of interest to you. We will discontinue sending such information on request.

Finally, we may use the Personal Information to contact you to request feedback of your stay and our retreat.

REFUND AND CANCELLATION POLICY

Refund Policy:

Spa Products – If for any reason you are not satisfied with a product you purchased, you can return it within 7 days of the original purchase date for a replacement or refund. You must have a valid receipt documenting that the purchase had been made within the last 7 days.

Spa Services – A Time to Spa strives to provide the utmost in customer service and satisfaction with spa services provided. If you are displeased with your spa service, please bring it to the attention of the receptionist at the time of checkout. It is our policy to ensure that all services are provided properly and professionally, and upon approval of spa management, you will be eligible to receive a follow-up complimentary service in order for us to have the chance to “make it right” and please you. We do not provide refunds for spa services or packages; the sole remedy is providing a complimentary follow-up service.

Amount once paid through the payment gateway shall not be refunded other than in the following circumstances: • Multiple times debiting of Customer’s Card/Bank Account due to technical error OR Customer's account being debited with excess amount in a single transaction due to technical error. In such cases, excess amount excluding Payment Gateway charges would be refunded to the Customer.

The Customer will have to make an application for refund along with the transaction number and original payment receipt if any generated at the time of making payments.

Company may elect to resolve any dispute, controversy or claim arising out of or relating to this Agreement or Service provided in connection with this Agreement by binding arbitration in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996. Any such dispute, controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party.

TERMS AND CONDITIONS FOR GIFT CERTIFICATES SOLD DURING ALL GIFT CERTIFICATE DISCOUNTED SALES PROMOTIONS

All Gift Certificate purchases are non-refundable and not redeemable for Cash.

Use of gift certificates sold at a discounted price cannot be combined with any other promos or discounts being offered by A Time to Spa

Gift certificates sold at a discounted price may not be used for product purchases.

Any add-ons to spa services will be charged at full retail price per our menu of services.

Services may not be lengthened in time when using a gift certificate sold at a discounted price.

RIGHT OF ADMISSION

We reserve the right to admit guests and offer spa therapies. Spa therapies will be offered only to medically fit persons of age 16 years and above. The decision of the spa team in declaring a guest fit and eligible to take a spa therapy is final and binding. Appointments are subject to availability and hence we recommend booking appointments well in advance.

FULL DISCLOSURE

Guests are required to make full disclosure of their health condition, allergies etc. at the front desk before starting their therapy since some spa therapies may not be recommended in case of contraindications.

LATE ARRIVALS

In case of late arrival by a guest beyond ten minutes of the scheduled appointment time, we reserve the right to shorten the therapy duration for the same price or offer a completely different therapy of a shorter duration. This is so that the next appointment is not delayed.

CUSTOMIZATION

The duration, technique and material used for every therapy is scientifically predetermined by our technical trainers. It will not be possible to modify or customize them beyond permissible limits.

INAPPROPRIATE BEHAVIOR

Our therapists reserve the right to stop any therapy at any point of time in the event of any inappropriate behavior, gestures, innuendos or requests of sexual nature by a guest. Such guests will be blacklisted and no further appointments will be offered to them.
